Terms and Conditions of COLONIASDEFERIAS.PT

The commercial company Pumpkin Enterprises – Consultoria de Gestão Lda. (hereinafter referred to simply as “Pumpkin”), with Corporate Taxpayer Identification Number 509300855, is the owner of the website with the address coloniasdeferias.pt, an online platform that allows you to book holiday camps, camps and ATLs, experiences and products from its partners.

The contract with partners and the service provided to users and partners is governed by a set of Terms and Conditions based on mutual respect and compliance with applicable legislation. The Terms and Conditions are based on the following set of rules:

1. Acceptance of terms

To use the Services, you must first accept the Terms. You may not use the Services if you do not accept the Terms.
You can accept the Terms:
- Using the reservation services for holiday camps, camps and ATLs, experiences and products from our partners.
You may not use the Services or accept the Terms if:
a) is not of legal age to enter into a binding contract
b) You are a person barred from receiving the Services under the laws of Portugal or other countries, including the country where you are resident or from which you use the Services.

1.4. Before continuing, Pumpkin recommends that you read these terms and conditions and privacy policy, print or save a local copy for archival purposes.

2. Contracting Parties

The contract for booking holiday camps, camps and ATLs, experiences and products is concluded between the person making the booking and the entity offering the service (hereinafter referred to as the organizer).

3. Conclusion of contract

The client submits on the platform coloniasdeferias.pt the reservation request. The platform forwards the reservation request to the organizer or service provider.
The contract for the provision of services for holiday camps, camps and ATLs, experiences and products, is concluded by the organizer or service provider, when sending the related agreements and documents to the client.
Pumpkin is not responsible for ensuring that the desired reservation is executed in any situation. The organizer's offer is limited and may no longer be available at the time of booking.

4. General Terms and Conditions of the Organizer

In addition to the general terms and conditions of the platform, the following apply: coloniasdeferias.pt, the organizer's general terms and conditions also apply. These may include payment terms, provisions regarding due dates, liability, cancellation, booking changes, and refunds, as well as other regulatory restrictions.
The organizer is responsible for transmitting its general terms and conditions at the time of accepting the booking request.

5. Reservation and Payment

Payments, cancellations or rescheduling are made exclusively between the person making the reservation and the organizer.
The respective organizer's payment methods apply. Therefore, Pumpkin never issues invoices to the customer.
If the person making the reservation has any questions about the trip details and the reservation process, they can contact the platform's customer service department. coloniasdeferias.pt. For questions that the platform's Customer Support service coloniasdeferias.pt is not aware, the platform team coloniasdeferias.pt can redirect the person making the reservation to the organizer's Customer Support service.
If the content of the organizer's acceptance statement differs from the content of the reservation made on the platform coloniasdeferias.pt, the organizer must make the content of their new offer available to the client and Pumpkin. The contract is concluded based on the new offer if the client notifies the organizer of their agreement to it through an explicit statement, an advance payment, or a final payment within the commitment period.

6. Customer Responsibility

The customer must comply with the partner's terms and conditions, which may include payment terms, provisions regarding due dates, liability, cancellation, rebooking and refunds, as well as other regulatory restrictions.

7. Organizer's Responsibility

The partner undertakes to provide Pumpkin, in a complete and accurate manner, with all relevant and necessary information for the promotion and sale of its offers, including photographs and the rights to use them.
It is the partner's responsibility to guarantee data protection and the rights to use and transfer the images made available to Pumpkin.
The partner must assure Pumpkin that it holds the rights to use and transfer the images provided to Pumpkin and guarantees that the people portrayed in the photographs have ceded their image rights.
The selling price of partner offers and invoiced to the customer on Pumpkin cannot differ from the normal price of the offer when booked directly with the partner.
The partner undertakes to immediately inform Pumpkin of any changes to the offer, including the introduction of sibling discounts, advance bookings, last-minute discounts, among others, so that Pumpkin can update the information on its platform.
Partner must immediately inform Pumpkin if an offer is fully booked.
The organizing partner undertakes to communicate any changes to the reservation made to customers in a timely manner.
The partner undertakes to carry out all the offers it organizes, except in cases stipulated in its General Terms and Conditions, namely if the minimum number of participants is not reached. The partner is fully responsible for any costs arising from failure to fulfill its obligations.
The partner undertakes to communicate to Pumpkin any changes to its General Terms and Conditions.

6. Data Protection

Pumpkin guarantees the confidentiality of the personal data of the traveler and the person making the reservation. This information will only be shared with the travel organizer at the time of booking.
By making a reservation request, the person making the reservation agrees to the electronic storage of their personal data and that of the participant for processing. See the Privacy Policy.

7. Cancellation of the service contract

The booking client or the participant themselves may cancel the trip by submitting a written statement to the organizer before the start of the trip. In the event of a booking change or contract cancellation, only the general terms and conditions of the organizer or service provider in question apply.
Pumpkin does not guarantee that cancellation notices sent to you incorrectly will be forwarded to the organizer.

8. Services provided outside the country

The participant is responsible for complying with the destination country's regulations regarding passports, visas, customs, currency, and health. Any costs and inconveniences resulting from non-compliance are the participant's sole responsibility.
All information provided by the platform coloniasdeferias.pt , is based on the assumption that the traveler is a Portuguese citizen.

9. Responsibility for any failures in the organizer's services

Pumpkin is not responsible for the execution of the services of the offers described in the documents or reserved on the website.
Travel information is based on information provided by the organizers and does not constitute any guarantee on our part. Pumpkin cannot be held responsible for the accuracy or completeness of the content.
Any complaints regarding the quality of the service provided must be immediately reported to the organizer. To prevent possible future occurrences, the customer can inform Pumpkin, which will make every effort to clarify the circumstances.
Pumpkin is not responsible for the loss, destruction or damage of travel documents during transit, for which it is not responsible.
If the customer becomes aware of an error made by Pumpkin, or should have known in good faith, they must immediately inform Pumpkin. Failure to do so will not hold Pumpkin liable for anything that could have reasonably been done with corrective measures.
